How Alaska judges are selected

According to the Alaska Judicial Council, the Alaska way of selecting judges is similar to other states. Alaska claims that it follows a merit system to select judges, and is similar to other states ways of selecting judges. These states believe this merit system is best to “achieve a fair, independent, impartial, and accountable judiciary. These judges are positioned by the governor of Alaska.


The Alaska Judicial Council is a citizens’ council commissioned to review the history of judges and the Alaskan judicial system’s integrity. This council has not escaped citizen concerns of participating in the corrupted protection of crimes committed by Alaskan judges and the misconduct of other judicial officials. The Alaska Grand Juror Association (AGJA) was established unofficially by citizen’s worried about widespread misconduct and negligence throughout the judicial process. This group has identified the lead judicial investigator, Marla Greenstein, as having spent around 35 years in her position. The integrity of her position is questionable.


The Council is used “to [screen] applicants for judgeships and nominates the two or more most qualified applicants to the governor.” It is mandatory that the governor make his judicial selections from the Council’s nominees.

Who is on the council and what are its concerns of impartiality?

According to the Alaska Judicial Council, the council is designed to have “three public (non-lawyer) members and three lawyer members. The chief justice of the Alaska System Court is the chair of the council, but only votes when necessary.”


The Council is appointed by the governor and the legislature to confirm a judge’s position. This raised concerns with AGJA, because Alaska’s Bar Association (ABA), used to monitor legal professionals, was taken over by Alaska’s Supreme Court in the early 1900s. This has led to legal professionals fearing the Supreme Court may control their professional future.


The Supreme Court hijacked all the funds that were once in the ABA control. The Supreme Court has an impact on the review of legal professionals in Alaska, This is usually avoided by the independence of a State’s Bar Association. Cowardly attorneys do not push back against the misconduct and negligence of judges that are before them. This has developed a culture of injustice against the people of Alaska, and the protection of judges and attorneys that are misbehaving.


Not only does the governor appoint the members of the Council, he can influence the state legislature to support his appointments. The Alaska Bar Association appoints three lawyers to the Council. Regardless, the Council is ineffective to prevent the intimidation of attorneys by judges with temperaments that are unbecoming the robes they wear.

“The governor appoints the public members, and the legislature confirms them. The lawyer members are appointed by the Board of Governors of the Alaska Bar Association. Each member serves a six-year term. Terms are staggered so that one member is appointed every year. Members come from different areas of the state. Council members serve as volunteers,” reports the Alaska Judicial Council.


What is the Merit System?

A merit system is used to select the “most qualified” to be selected for a judicial position. The Council reviews the record judicial candidates with the following considerations:

1. Professional Competence. Intellect, legal knowledge, written and oral communication skills, and ability to work and communicate well with various people.

2. Diligence and Administrative Skills. Including organizational and case management skills.

3. Integrity. Consistent history of honesty and high moral character.

4. Fairness. Ability to be impartial to all, and commitment to equal justice under the law.

5. Temperament. Compassion, humility, and a history of courtesy and civility.

Judgment and Common Sense. Balance between knowledge and practical reality.

6. Legal Experience. Amount and breadth of legal experience, and the suitability of that experience for the position sought.

7. Life Experience. Diversity of experience, exposure to persons of different ethnic and cultural backgrounds, and demonstrated interests in areas outside the legal field.

8. Public and Community Service. Demonstrated commitment to equal justice, and to the legal needs of the diverse communities of Alaska, commitment to the community generally, and to improving the justice system in particular.

Also, the Council and courts hav been prioritizing the need for diversity and inclusion. On July 30, 2024, the Alaska Beacon published an article named, “Alaska Supreme Court positioned to be majority-women for the first time.” Alaskans are realizing that too many officials were not being selected by merit but by demographics. This shows in judges’ orders, whereas they dismiss evidence, are inconsistent with judgements, judges are making up the law and legal reasoning to benefit the State and corrupted judicial officers.

How Alaskan Judges are retained.

After a judge has been selected by the governor, a judge is reelected by the people through elections. Every few years a judge appears on the election ballots for citizens to vote on their retention as judges. Voters are often unaware of the character of the judges on the ballot. Many voters will vote to approve judges “down ballot”. These voters have too much trust in the judicial system and its adherence to the law.

AGJA recommends Alaskans to vote “NO” for the retention of ALL judges, because the Alaska judicial system is seen as systemically corrupted.

Judges on the 2024 Alaska election ballots are based on jurisdiction. Therefore, not all judges are available for a vote on all ballots. The last day to vote is Election Day, November 5, 2024.
